Many buyers want to purchase property in the numerous small villages around Kaş and Kalkan. While this is possible, there are strict laws in place, designed to protect the countryside from over-development. We would never advise our clients to try to circumnavigate those laws, as this would leave them unprotected by a Court of Law if something were to go wrong. For this reason, we do not include properties within our searches for which we think it is unlikely that a foreigner would be able to obtain clean title.
While you would need to seek specific advice from a lawyer to ensure that you could legally own any particular property, just to give you an idea of the rules, they are largely as follows:
Land or property located in villages which fall within the belediye (municipality) of Kaş or Kalkan are treated as if they were in the town centre and have few restrictions in terms of foreign ownership.
Land or property located in villages which fall outside the belediye, but inside a village boundary according to the local plan, can be purchased by foreigners, as long as they are within an 'Imar' (a local development plan). If they are not, it is often possible to obtain an Imar, though this can take some time and is quite costly. The charges are approximately 15,000 YTL (around £6,000) per application, plus a further 1,000 YTL (around £400) for each 1,000 square metres of land (both charges payable only if the Imar is granted – the planning department will levy an additional small fee to consider the application). You would also need to add to that the costs of obtaining advice from a surveyor, who would make the application on your behalf. There is no guarantee that an Imar would be granted and you would have to undertake a notarised agreement with the seller while the application is submitted.
Some developers and landowners have already obtained an Imar for their land or property, making it fully eligible for sale to a foreigner. This will, of course, be reflected in the sale price.
Land or property which does not fall within a belidiye or a village boundary cannot be owned by foreigners and you should not attempt to purchase such a property. The government has recently introduced specific legislation in this respect and it is expected that it will be rigorously applied.
